Discounts are based on total number of pages or spending during a one-year contract period. Frequency discounts should be applied on a National Equivalent Page (NEP) basis, or Dollar Volume discounts should be based on total gross spending at the open rate after deducting production allowances for supplied units.

 

General Advertising Provisions

1. Rates are based on average net paid circulation of six months, effective with the issue date January 2001. Announcement of any changes in rates will be made at least four weeks in advance of the issue date of the first issue to which such rates will be applicable.

2. Advertisers may not cancel orders for, or make changes in, advertising after the closing date.

3. Agency commission: 15%. Premium charges for gatefolds and other special advertising units are non-commissionable and non-discountable.

4. Bills are rendered on or about the on-sale date; payment is due within 20 days from the date of the invoice. No cash discount is available.

5. All discounts must be used within six months after the period in which they were earned. Unused discounts will expire six months after the period in which they were earned.

6. All advertisements are accepted and published by the Publisher upon representation that the agency and advertiser are authorized to publish the entire contents and subject matter thereof and that such publication will not violate any law or infringe upon any right of any party. In consideration of the Publisher's acceptance of such advertisements for publication, the agency and advertiser will jointly and severally indemnify and save the Publisher harmless from and against any loss or expense, including reasonable attorneys' fees, arising out of publication of such advertisements, including, without limitation, those resulting from claims or suits for defamation, violation of the Lanham Act or rights of publicity or privacy, misappropriation and copyright or trademark infringement or from any and all similar claims now known or hereafter devised. It is understood that the advertiser and agency are jointly and severally liable for the payment of invoices for advertising published hereunder.

7. In consideration of the Publisher's reviewing for acceptance, or acceptance of, any advertising for publication, the agency and advertiser agree not to make promotional or merchandising reference to Sports Illustrated For Kids in any way except with the express permission of the Publisher for each use.

8. The Publisher shall not be subject to any liability whatever for any failure to publish or circulate all or part of any issue or issues because of strikes, work stoppages, accidents, fires, acts of God or any other circumstances not within the control of the Publisher.

9. SPORTS ILLUSTRATED FOR KIDS is not responsible for errors in key numbers or other type set by the Publisher.

10. No conditions, printed or otherwise, appearing on contracts, orders or copy instructions that conflict with the provisions set forth herein will be binding on the Publisher. All advertising position clauses or conditions are treated as requests only and cannot be guaranteed. The Publisher's inability or failure to comply with any such clauses or conditions shall not relieve the agency or advertiser of the obligation to pay for the advertising.

11. The Publisher reserves the right to reject or cancel any advertising for any reason at any time. All advertisements must be clearly and prominently identified by trademark and/or signature of the advertiser.
