LAUSANNE, Switzerland (AP) -The Court of Arbitration for Sport will hear an appeal from the Netherlands Antilles Olympic Committee to return Churandy Martina's silver medal in the 200 meters.

Martina finished second to world-record setter Usain Bolt, but was disqualified for running out of his lane at the Beijing Olympics.

The Caribbean island team claimed the protest was filed outside of the 30-minute, post-race limit set by the International Association of Athletics Federations.

The NAOC asked "to invalidate the procedure followed by the IAAF jury of appeal and to annul the disqualification of Churandy Martina, mainly for formal reasons,'' the court said in a statement.

The U.S. team filed the protest against Martina after studying footage of its own runner, Wallace Spearmon. He was disqualified from third place for the same error.

The silver medal was eventually awarded to American Shawn Crawford, and teammate Walter Dix received the bronze.

The Netherlands Antilles team has described the matter as a "David and Goliath case,'' in standing up the IAAF and the U.S. team.

Speaking in Beijing last month, NAOC president William Millerson said: "We're not going away. We cannot do that because, even being a small country, we have our pride.''

No date has been set for the hearing.
